Elka Electric Scooters – Legal Disclaimer

Although it is legal to sell electric scooters for use on private land, riding an electric scooter on public roads or pavements is forbidden in the UK at present. The only place where it is legal to ride an electric scooter is private land, with the permission of the landowner. Riders currently face a £300.00 fixed-penalty notice and six points on their driving licence for riding electric scooters on public land.

Currently, Electric scooters are classified as Personal Light Electric Vehicles (PLEVs), and as a result are treated by the law as motor vehicles. This means that they are subject to all the same requirements as a motor vehicle is subject to – MOT, tax, licensing and construction requirements – such as having visible rear red lights, number plates and signalling ability. Electric scooters do not have standard number plates, insurance or signaling ability (amongst a few other things), and as a result, are not currently legal for usage on public roads or pavements.

The government concluded a consultation earlier this year on the future of mobility, in which several respondents said that the law on electric scooters should be changed, but there has been no movement so far.

It is important to note that by purchasing the Elka Model-T electric scooter, the customer accepts our T&Cs, and with that, accepts full responsibility for riding on public land. Neither Elka, nor the Distributor, will be liable for any charges or fines associated with usage in public areas. However, we recommend that the Distributor inserts the following disclaimer on their website as well as any other customer-facing points: “Please note that under current UK legislation the Elka Model-T is not legally permitted to be used on public roads or pavements. While this law is enforced to varying degrees and seems likely to change, by purchasing the Model-T you accept full responsibility for riding on public roads and pavements, and are legally liable should there be any ramifications.”
